Acceptance of Terms

By accessing our website or engaging our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Description

MetaCache Cybersecurity provides threat intelligence, security investigations, and comprehensive security audit services. Specific service details are outlined in individual Statements of Work (SOW).

Service Engagement

All security services require:

  • Signed Master Service Agreement (MSA) or Non-Disclosure Agreement (NDA)
  • Detailed Statement of Work (SOW) defining scope and objectives
  • Written authorization for any testing activities
  • Compliance with applicable laws and regulations

Client Responsibilities

Clients must:

  • Provide accurate information and access necessary for service delivery
  • Ensure legal authority for requested services
  • Implement recommended security measures in a timely manner
  • Maintain confidentiality of our methodologies and findings
  • Notify relevant parties of authorized testing activities

Scope Limitations

Our services are limited to:

  • Assets and systems explicitly authorized in the SOW
  • Testing methodologies agreed upon in advance
  • Compliance with applicable legal and regulatory requirements
  • Professional cybersecurity practices and industry standards

Confidentiality

We maintain strict confidentiality regarding all client information, findings, and methodologies. Both parties agree to protect confidential information under separate confidentiality agreements.

Liability and Disclaimers

Our liability is limited to the fees paid for services. We provide services "as is" and make no warranties regarding security completeness or future threat protection. Clients are responsible for implementing recommendations and maintaining ongoing security.

Intellectual Property

We retain ownership of our methodologies, tools, and know-how. Clients receive licenses to use deliverables for their internal security purposes. Custom tools or reports remain our intellectual property unless otherwise agreed.

Payment Terms

Payment terms are specified in individual SOWs. Generally:

  • Payment is due within 30 days of invoice
  • Expenses and costs are billed separately
  • Late payments may result in service suspension
  • Disputed charges must be raised within 30 days

Termination

Either party may terminate services with written notice. Termination does not relieve obligations regarding confidentiality, payment for services rendered, or return of confidential materials.

Force Majeure

Neither party is liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, government actions, or cyber attacks affecting our infrastructure.

Dispute Resolution

Disputes will be resolved through good faith negotiation. If unresolved, disputes may be submitted to binding arbitration under applicable arbitration rules.

Governing Law

These terms are governed by the laws of India. Any legal proceedings will be conducted in appropriate Indian courts with jurisdiction.

Modifications

We reserve the right to modify these terms with reasonable notice. Continued use of services constitutes acceptance of modified terms.

Severability

If any provision is found unenforceable, the remaining provisions continue in full force and effect.
